In 1955 Mae Boren Axton co-wrote Elvis's hit song HEARTBREAK HOTEL with Tommy Durden. Durden got the idea from a newspaper article he read about a man who had killed himself, leaving behind only the message "I walk a lonely street." It was Axton who created the verse "HEARTBREAK HOTEL" for the end of the man's lonely street.

Why illegal? Because the California Invasion of Privacy Act was passed into law by the California Legislature on Friday, July 28, 1967. Meaning, you could not and still cannot (California has always been a two-party state) record a phone conversation without the consent of all parties in the conversation agreeing to be taped.

In 1968, Congress passed a law that provided warrants for wiretapping in criminal investigations only. National security was not at stake, Elvis was not committing any crimes, there was no criminal investigation going on, and Red West did not have a warrant. Elvis’s expectation of privacy was violated.
